Eligibility to Buy Private Property In the year 1973, the Singapore Government has imposed restrictions on foreign ownership of all private residential property in Singapore. Such ownership is governed by the Residential Property Act. The Act aims to give Singaporeans a stake in the country by being able to buy and possess their own residential property at an affordable price and also encourage foreign talent by allowing permanent residents and foreign companies who make an economic contribution to Singapore to purchase such properties for their own occupation. The Residential Property Act (RPA) is then amended on 19 July 2005 to allow foreigners to purchase apartments in non-condominium developments of less than 6 levels without the need to obtain prior approval. For restricted property such as vacant land, landed properties such as bungalows, semi-detached and terrace houses, prior approval is still needed if foreigners wish to buy. Landed properties is a special class of residential property that Singaporeans aspire to own, and should remain restricted. Foreigners need to apply for approval from Singapore Land Authority before buying. Foreign persons (including natural persons, foreign companies and societies) are restricted from purchasing: Vacant land Landed residential property, such as bungalows, terrace houses, semi-detached houses Residential property in a building of less than 6 levels Other restricted properties A HDB Shophouse A HDB flat purchased directly from HDB A resale HDB flat where HDB has consented to the sale Executive Condominium bought under the Executive Condominium Housing Scheme Act, 1996 Eligibility to Buy HDB Property and Executive Condominiums HDB Flats are apartments built and maintained by the Housing Development Board (HDB). More than 80% of Singaporeans live in HDB housing estates. HDB housing estates are usually self-contained towns with clinics, schools, supermarkets, food centres, as well as sports and recreational facilities. For the classification of HDB flats, the living room is counted as one room. To buy a flat directly from HDB, you must be a Singapore citizen, must include another Singapore citizen or Singapore permanent resident to form a family nucleus. To buy a flat from the resale market, you must be a Singapore citizen or Singapore permanent resident. Include at least one listed occupier who is a Singapore permanent resident or Singapore citizen. Executive Condominiums (EC) were introduced to cater to Singaporeans, especially young graduates and professionals who can afford more than an HDB flat but find private property out of their reach. ECs are comparable in design and facilities to private condominiums as they are developed and sold by private developers. The first owner of a Executive Condominium are not allowed to re-sell their unit in the secondary market within the first 5 years. After the initial 5 years, owners are allowed to sell their units to Singaporeans. Foreigners can be only buy a Executive Condominium after 10 years, in which all restrictions will be lifted. For HDB flats, HDB shophouse and Executive Condominiums, eligibility is subjected to the Housing And Development Board. Private residential properties investment will be considered for application for Permanent Resident application. A foreigner can be considered for PR status if he invests at least S$2 million in business set-ups, other investment vehicles such as venture capital funds, foundations or trusts, and/or private residential properties. Up to 50% of the investment can be in private residential properties, subject to foreign ownership restrictions under the Residential Property Act (RPA). This is to attract and anchor foreign talent in Singapore. Property Search   Engage a Realtor A professional property agent in Singapore will assist you and protect your interest throughout the purchase, secure the offer for you at the best possible price. With a much better knowledge of Singapore, the agent will be in a better position to recommend and advice on the choice of property. He will also ensure that all documents are in order and you are dealing with the rightful owner of the property. Use Only 1 Agent Most property companies share the same database of property listings in Singapore. Therefore use only ONE agent at a time. If you approach many agents at the same time, very likely that they will show you the same property. Much confusion and embarrassment will arise if you engage many agents. Using 1 agent, you will save valuable time for yourself and the agent. He will then understand your needs and requirements better after a few viewings. Only if they are incompetence, unresponsive or not showing the correct property you wanted, then start to look for another agent. Location, Budget, Stamp Duty, Rental Yield   Location Depending whether you are buying the property for own stay or investment, location plays an important role. Properties in prime districts retain their value very well and they usually have the highest capital gain in a bullish property market. Properties in the suburbs are lower in price and may be more suitable for own stay than investment. If you can purchasing the property for investment, the properties in prime districts like district 09, 10, 11 or the Central Business District are the safest buy. Properties with sea view at the East Coast are also great for a resort home or investment. Budget How much cash upfront you willing to pay for the property? How much CPF in your ordinary account that you can use for the purchase? The latest MAS ruling allows purchaser to loan up to 80% of the valuation or purchase price, whichever is lower. 10% must be paid in cash and the other 10% can be paid using CPF or cash. Buyer's Stamp Duty (BSD) Stamp Duty Based on the Purchase Price or Market Value, whichever is higher:   Every $100 or part thereof of the first $180,000 - $1 Every $100 or part thereof of the next $180,000 - $2 Every $100 or part thereof of the remainder - $3 For ease of calculation, if the purchase price is more than $300,000, stamp duty payable will be: 3% of purchase price minus $5,400 Additional Buyer's Stamp Duty (ABSD) On 7 December 2011, the Government announced the introduction of the Additional Buyer's Stamp Duty (ABSD) to be paid by certain groups of people who buy or acquire residential properties (including residential land) on or after 8 Dec 2011. Subsequently, on 11 Jan 2013, the Government announced the revised ABSD rates applicable to purchases or acquisitions of residential properties on or after 12 Jan 2013.   Affected buyers are required to pay ABSD on top of the existing Buyer's Stamp Duty (BSD). From 12 Jan 2013, buyers or transferees who are:   a) Foreigners (FR) and entities would have to pay ABSD of 15% on the purchase or acquisition of any residential property.   b)(i) Singapore Permanent Residents (SPR) would have to pay ABSD of 5% on the purchase or acquisition of their first residential property.   b)(ii) Singapore Permanent Residents (SPR) who already own 1 or more residential properties would have to pay ABSD of 10% on the purchase or acquisition of another residential property.   c)(i) Singapore Citizens (SC) who already own one residential property would have to pay ABSD of 7% on the purchase or acquisition of the second residential property.   c)(ii) Singapore Citizens (SC) who already own two or more residential properties would have to pay ABSD of 10% on the purchase or acquisition of another residential property.   The ABSD is payable by affected buyers at fixed rates on the actual price paid or market value of the property whichever is the higher.     Profile of buyer ABSD rates (from 12 Jan 2013) FR and entities buying residential property 15% SPR buying 1st residential property 5% SPR buying second and subsequent residential property 10% SC buying the first residential property Nil SC buying second residential property 7% SC buying the third and subsequent residential property 10%   ABSD: Additional Buyer's Stamp Duty FR: Foreigners SPR: Singapore Permanent Residents SC: Singapore Citizens   Visit IRAS website for more info: http://www.iras.gov.sg/irasHome/page04 .aspx?id=12832 Rental Yield If you are buying the property for investment and intend to rent out the property, calculate the yearly rental yield versus the purchase price. Properties at district 09, 10 and 11 easily yield the highest rental returns. Due to the premium in price for freehold properties, they most likely have lower rental yields than leasehold properties. If you are a non-residential foreigner (no valid employment permit or pass for long stay) purchasing a property for rental returns, do not forget to factor the personal income tax, which is moderately high at 20%. For foreigners who are working in Singapore with valid employment status, the tax rate will be much lower. Visit the IRAS website for more info on taxes. Valuation & Loan Check the indicative valuation for the property you intending to buy. Valuation directly affects the amount of loan you can get for the property. Take into account the number of years that you can loan, the monthly instalments, etc. On 12 January 2013, MAS announced new property cooling measures by lowering the Loan-to-Value (LTV) Limits and increasing the Minimum Cash Down Payment. a) For individual borrowers who have no outstanding housing loans, the LTV limit will be 80%, or 60% if the loan tenure exceeds 30 years or the loan period extends beyond the borrower's retirement age of 65.   b) For individuals obtaining a second housing loan, the Loan-to-Value (LTV) limits will be 50%, or 30% if the loan tenure exceeds 30 years or the loan period extends beyond the borrower's retirement age of 65.   b) For individuals obtaining third or subsequent housing loans, the LTV limits will be 40% or 20% if the loan tenure exceeds 30 years or the loan period extends beyond the borrower's retirement age of 65.   d) For non-individual borrowers, the LTV limit will be 20%.   For HDB flats, you may want to check the eligibility to get a concession loan from HDB. If you are not entitled to get the loan from HDB, the other way is to get it financed by a commercial bank. Documentation for Private Property   Option to Purchase You have decided to purchase a property. Prepare 1% of the purchase price (as a consideration) in exchange for the Option to Purchase from the seller. Option to Purchase is usually prepared by the seller's (vendor) solicitor or property agent. You are usually given 14 days to decide whether to proceed with the purchase. If you decide to proceed, exercise the option by signing in your solicitor's office and forward it to the seller's solicitor together with another 4% or 9% (agreement between the vendor and purchaser) of the purchase price. Offer to Purchase Alternatively, you can ask your realtor to prepare the Offer to Purchase and attention to the seller. Clearly stating the price, sales completion date and others. Terms and conditions can be drafted by your solicitor or your realtor. Completion of Sale From then on, leave it to your solicitor for the completion of the sale, which will be completed in around 8 to 10 weeks time (agreement between the vendor and purchaser). Your solicitor will lodge a caveat on the property, coordinate with the financial institution, CPF board (if applicable), prepare the mortgagor/mortgagee documents. Stamp fee will be payable to Inland Revenue Authority of Singapore within 14 days upon exercising the Option to Purchase or signing the Sales and Purchase Agreement when you buy from a property developer. For stamp fee payable, refer to the 'Buyer's Stamp Duty (BSD)' and 'Additional Buyer's Stamp Duty (ABSD)' sections above. For HDB flats, there is also an option period of 21 days for the buyer to consider over the intended purchase, to check his eligibility, financing aspects and other issues such as whether the flat is affected by redevelopment/upgrading, the liability to pay upgrading cost/levy etc. If the buyer does not wish to buy the resale flat, he can let the Option expire and loses only the option fee. To ensure a standardised practice, HDB has the following guidelines for the Option Fee, Deposit and Option Period: Option Fee - An amount not exceeding $1,000 Deposit - An amount not exceeding $5,000 (including the Option Fee) Option Period - 21 calendar days Please visit the HDB website for more details. Inspection Before Taking Over Property The buyer can request and state clearly in the Option to Purchase for permission to inspect the property before the completion of the sale. Check the fixtures and fittings, and also the items that the seller had agreed to sell with the property. For HDB flats, HDB will do the inspection on your behalf. They will check for any unauthorised renovation. Seller will need to reinstate the flat into the condition allowed before HDB approve the sale. Commission Payable As each realtor may charge differently, please refer to your realtor for the service fee payable. Buyer and seller should ensure that an invoice from a licenced real estate agency is issued to them. Home maintenance & Improvement fund / Condominium Covenants, Conditions & Restrictions (CC&Rs)

  A home maintenance fund pays for the daily upkeep of your house. Any repairs or minor touch-ups you are sure to do for your home will benefit from having a separate fund. Having money on hand to take care of any sudden or planned renovations will go a long way in easing your financial burden. A separate fund means there is always a growing pool of money sequestered away for a rainy day. To start a home maintenance fund, you will need to determine how much of a fixed monthly amount you should save. This usually translates to a small percentage of your overall property value. However, in Singapore where public housing have expensive price tags of $800,000 and above, saving a percentage of this every month might be largely impractical. For instance, keeping aside 1% of an $800,000 property value is $8,000 a month. If a couple earns $6,000 collectively each month, coming up with $8,000 is just not possible. What more for someone whom earns $1,000 a month? However, if you took out 1/12 of that 1%, it would be a lot easier to manage. 1% of 1/12 of $800,000 is $800. As most people live in HDB flats, $800 a month can accrue to a much larger sum that will come in handy if you need to spruce up your home in order to sell it in the future. Unlike private property HDB flat owners do not have to take care of the roofs or lawns. Your maintenance involves painting the walls, keeping the kitchen and bathrooms in good working condition and the occasional furniture purchase. All external repairs excluding the door and gate will be managed by HDB and in some cases you will pay for it with your CPF. Your maintenance fund, if you live in a HDB flat can also double as a home improvement fund. But if you live on private property, these two funds need to be separated as everything on your property is your responsibility. The government will not pitch in to fix your roof so keep the maintenance funds for fixing roofs, gates, lawns, dripping hoses and everything else separate from the fund you're saving for when you turn your spare room into a bar. As an owner of a private home, you should be financially more able to run two funds concurrently than an owner of a HDB flat. Home improvements are going to typically cost you a bit more than intermittent renovations so it would make sense for you to keep aside about $200 more than what you've already established for the maintenance fund. The home improvement fund is optional as not everyone has intentions to upgrade their homes. The maintenance fund however is mandatory. Your home, no matter how new it is will endure wear and tear and you need to be prepared to fix it or it will get worse. Besides, if you ever intend to sell and attain the best possible price for your property, having a broken down house will be a financial burden to the potential buyer who does not intend to spend more than the value of the property.   ------------------------------- ----------------------------   Condominiu ms or Condos are a type of private residential property consisting of a collection of individually owned apartment units housed in an entire development. Condos are known for their in-house communal facilities. They share many similar features with Executive Condominiums. The main difference is that regular condos are given immediate private property status and are readily available for purchase by foreigners. ECs are only converted into private property ten years after construction during which time it will be then become available for purchase by foreigners. This means on the 11th year of its development onward. For a development to be granted condominium status the size of the site must be at least 40,000 sqft and residents are expected to be given complete access to all common areas and facilities such as swimming pool, gymnasium and BBQ areas. Facility types are not expected to follow a stringent guideline as they differ from condo to condo depending on various outcomes such as size and space constraints. A typical condo will have exclusive features such as the a swimming pool, gymnasium, and BBQ areas as well facilities like car parks, terrace garden, badminton courts, tennis courts and security services.  Security services are usually automated or physically manned by security guards. Some condos utilize a combination of both for maximum security. Condos come in the form of studio units, penthouse units, individual houses or multiple-room units. They cater mostly to an affluent or semi-affluent group of people who prefer a more extravagant type of living as opposed to a HDB flat but one not as expensive as landed property. Generally, condos are classified into three categories; Mass Market Condos, Mid-Market Condos and Hig-End Condos. You can read more about this. Condos are also unique because of the condo association system which involves the owners of the condo units. It is an elected board of members from the respective condo community which serves as the management and jointly represents ownership of the entire place. Getting a new home is a great choice because there is no need to undertake expensive and messy renovation work or repair the existing plumbing and electrical wiring. As the place is ready for occupation, the key to the front door is given to you. All you have to worry about is where to place the furniture. Greater flexibility Buying a newly completed home is easy because it allows you the flexibility in decision-making. Home seekers who are not in a rush can buy during a launch or during construction; but of course for those who want to move in immediately, the completed project is ideal as there are usually some units left over. These units are sold directly by developers, which means you get a brand new unit and there are usually a gamut of choices on various floors as well.   Affordability There are other benefits too, such as affordability. The selling price of some new projects can be lower than resale homes, which means that you are getting brand new facilities at a better price and you don't have to spend more money renovating the place.   Property can be a worthy long-term investment. But like all investments, research should always be done. In the right circumstances, your investment can grow in value. Anecdotally, people have sold their units even before the apartments are completed. Others choose to use their property as rental units, and they could see returns almost immediately. So where can you buy a newly completed home? There are many such projects being sold all across Singapore as we speak. Many large developers have stocks of developments that are ready for occupation. So if you're keen to purchase a new home and would like to move in as soon as possible, then you might want to act now. Happy house hunting!   -------------------------------- ---------------------------     Build-To-O rder flats are newly designed apartments mass released to meet the public housing demand. Buyers can choose from several locations available. Resale flat are older and most have less than 99-year left on the lease. A BTO and resale flat each has their own set of benefits and appeal to the different types of eligible applicant. We'll take a look at some of the pros and cons of BTOs and resale flats. BTO Pros 1. Compared to resale flats, BTOs are certainly the cheaper option. 2. Design-wise, most BTOs mimic condo designs 3. BTO flats tend to come with added facilities in and around the building 4. BTO flats are now built to be eco-friendly 5. BTO flats take a short time to complete 6. The flat is new and you begin with 99-year leasehold status BTO Cons 1. Interior of BTOs may require renovations according to applicants' preference 2. BTO 5-room flats are much smaller than 5-room resale flats 3. BTO flats are generally built in non-mature towns making it difficult for couples to live near their families 4. Price is non-negotiable Resale Pros 1. Resale flats are bigger - rooms, kitchen, bathrooms, living room are all far more spacious 2. Little to no renovation is required if the flat is in a good condition 3. Very little wait time as resale flats can be acquired as soon as both parties come to a mutual agreement 4. Resale flats are in mature estates making it easy for couples to live close to their parents 5. Resale flats in mature estates have established infrastructure and amenities 6. Prices are negotiable 7. Eligible for additional housing grant if you live near your parents Resale Cons 1. Resale flats are much more expensive due to the Cash over valuation (COV) 2. Resale flats are less than 99 years. It is possible to end up paying too high a price because of COV for a flat with not many years left 3. More time may be spent searching for a suitable flat 4. Process can involve several third parties such as housing agents and lawyers No doubt both BTOs and Resale flats come with negatives and positives; the final decision however, is what is best for you and your family. ------------------------------------ ------------------------   The first thing to do is check HDB for all upcoming Build-to-Order (BTO) exercises. HDB will announce this in the newspapers, on their InfoWEB and through other media sites. Interested parties will be provided with information pertaining to the BTO such as; 1. Location 2. Indicative prices 3. Preliminary designs 4. Number of units of flats offered 5. Race quota Before applying, remember to check your eligibility for buying a flat and taking a loan. If you are eligible on both fronts, you then need to review your finances and ensure you have enough money to pay for option fees, down payments, legal fees, resale levy, renovation costs, home protection insurance and other related costs. Once everything is in order, fill in the application and submit it online to HDB at www.hdb.gov.sg. Alternatively, you can visit HDB hub or any of the HDB branches and submit your application in person if you do not have access to the internet. At this point, you will be expected to pay a non-refundable fee of $10. HDB will release the queue position to applicants at the end of the application period. If there is sufficient demand, a computer ballot will be conducted by HDB to determine the queue position of each applicant. Those that are not shortlisted will be notified of this. If you are shortlisted, you will be required to pay the Option Fee. The Option fees are as follows; 1. 4/5- room and Executive flats: $2,000 2. 3-room: $1,000 3. 2-room: $500 4. Studio apartment: $250 There are also documents you are required to bring with you during payment of the Option Fee. Ensure that all persons listed in the application present their respective documents; 1. Identity Cards 2. Birth Certificates of children for proof of relationship 3. Passport for non-citizens to confirm residential status in Singapore 4. Income documents for assessment of income ceiling to buy a flat 5. Income documents for assessment of income ceiling if Additional CPF Housing Grant (AHG) or Special Housing Grant (SHG) are taken. If all the documents are in order, HDB will call you to sign the lease. This can range from three to six months. You will be required to submit loan documents when you sign the lease. If you are applying for a housing loan with HDB, this will be the HDB Loan Eligibility (HLE). If you are applying with the banks, then this is the Letter of Offer. There will also be a down payment of 1-3% of legal and stamp fees either by cash or CPF money. The costs involved differ and information regarding it can be found. Once all documents have been submitted and processes completed, the application is now finalized and you can collect your keys to your BTO in about 3 years. ------------------------------------- ----------------------   Monetary incentives Buying a resale flats allows you to participate in the Government's $30,000 grant (or $40,000 if you live within 2km of your parents. However, there are restrictions to this incentive. First of all, in future you will not be eligible to purchase a HDB flat or an executive condominium, or you will have to pay a large levy. Secondly, you will have to wait for a period of five years before you can sell your resale flat. Size matters If you have a large family, or you're simply looking for a home with lots of space, then resale flats should be your pick. They are larger than new flats. Take a 5-room resale flat as an example. It is 100 square feet larger than a new 5-room flat. It's interesting to note that flats in older HDB estates are more spacious, due to the lack of multi-storey carparks.   Location, location, location Homeowners are very particular about where they stay. Their home must be close to amenities such as shopping centres, MRT stations, bus interchanges, schools and places of work. With resale flats, they have a wider choice of where to live because resale flats can be found all across Singapore. Bargaining chip The HDB tends to be a stickler for rules. If a flat is priced at a certain amount, there is no way that you can haggle for a cheaper price. On the other hand, you can negotiate with the resale flat's owner on the price. Many of them are open to this as they are keen to sell their place as soon as possible. Selling restrictions Take note that if and when you decide to sell your resale flat, you will face fewer selling restrictions. If you decide not to take a HDB grant, you can sell a resale flat after 5 years with the new ruling from HDB. Moving day Moving into a resale flat is much less stressful. You can move in almost immediately. This is true for new flats that come under the walk-in selection scheme. However, if it's a built-to-order flat that you're looking for, then you will have to wait about three years to move into one.   Throwing out the trash Dumping the trash is something we take for granted. In a resale flat, you can dump your rubbish immediately. In new flats, you must store your rubbish in your flat until you are ready to go outside and dump it. This is because trash chutes in new estates are located near the lifts on each floor. Amenities galore Resale flats are located in older estates, and this means that hawker centres, shops, wet markets and public transportation systems are in place to serve you and make your life more convenient. In many new estates, these amenities may not be up and running and can lead to lots of inconveniences. Getting a good deal Wonder how much your resale flat is worth on the market? You will have a good idea of how much it is worth because of the selling price for similar flats which have been sold recently. For new flats, it is difficult to gauge if you are getting a good deal or over-paying. The reason for this is because market prices for new flats will not be established until sales are permitted, after five years.

What do I need to consider when selling a private property?   Firstly, you need to consider the date you bought the property as seller’s stamp may apply. If the property was purchased before 30th Auguest 2010, there is no seller stamp duty. However, if it was purchase between 30th August 2010 to 14th January 2011, seller stamp duty will be as follows:   1st year – full stamp duty (Same formulae as buyer’s stamp duty, i.e. (Purchase price X 3%) - $5,400. 2nd year – 2/3 of the seller’s stamp duty 3rd year – 1/3 of the seller’s stamp duty   If the property was purchased after 14th January 2011, the seller’s stamp duty will be calculated based on a percentage of the selling price, i.e. if sold within the 1st year = 16%, 2nd year = 12%, 3rd year = 8%, 4th year = 4% and 5th year = 0%.   Secondly, you should consider dressing up your property, i.e. clear clutter, basic cleaning, re-painting the walls, perform some minor renovation. It’s important to make the property as appealing and marketable to potential buyers as possible. You will be amazed how much value you can add to your property by good preparation: ensure you "dress it" appropriately and make it impressive for people viewing.   Finally, if the property is currently tenanted, it can be sold with tenancy. The new buyer must honour the tenancy agreement as it is legally binding and must allow the tenant to stay in the property until expiry unless a deal is negotiated between them for an early release.     Can I sell my property to a foreigner?   There are no restrictions against foreigners purchasing private condominiums and apartments. However, foreigners are not allowed to purchase landed properties. Only Singapore citizens and Permanent residents who have obtained special approval from the Land Development Authority, are eligible to buy. Landed properties include bungalows, semi-detached houses, terrace houses and some conservation shop houses.     After a potential buyer makes an offer, what happens next?   Once you have received an offer from a buyer, an initial deposit equivalent to 1% of the purchase price will be given to you for an exchange of the “Option to purchase” (OTP), which the buyer has 14 days to decide if he/she wants to exercise the option.   If the buyer decides not to, the option money will be forfeited. If the buyer intends to exercise the option and purchase the property, he/she must do so before the end of the 14 days.   Once the option is exercised, the buyer must pay the next 4% of the purchase price, taking the total deposit up to 5%.   The buyer is also required to pay the stamp duty to IRAS within 14 days of exercising the OTP. His/her lawyer will help make the payment, conduct the required checks and liaise with the seller’s lawyer to complete the purchase. Typically, the stage from exercising OTP to completion date takes 8 to 12 weeks.     What do I need to do prior to the completion date?   Before the completion date, you will need to make sure that the management fee, sinking fund and property taxes are paid. If you have paid your management fees in advance, the buyer must refund you for any fees you have paid after the completion date of the sale. You also need to inform your insurance policy to terminate your home insurance on the completion date.   If you have agreed with the buyer to leave any fixtures or fittings in the property for him/her as part of the sales agreement, you must do so when you move out of the property. You should also take care not to cause any major damage to the property during the move and be ready for the buyer to inspect the property prior to take over.
